1. Acceptance of Terms
By accessing and using BuildHelp (buildhelp.dev), operated by 28 Corp. ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Service
BuildHelp is a marketplace platform that connects clients who have unfinished or broken software projects with developers who specialize in completing and fixing such projects. We facilitate connections, payments, and project management but are not a party to the contracts between clients and developers.
3. User Accounts
To use certain features of BuildHelp, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use
- Accept responsibility for all activities under your account
4. Platform Commission
BuildHelp charges a platform commission on completed projects. The standard commission rate is 8% of the project value. Premium developers may qualify for reduced commission rates. All fees are clearly displayed before you agree to any transaction.
5. Payments and Escrow
All payments are processed through Stripe. When a client accepts a developer's proposal:
- The agreed amount is charged to the client
- Funds are held in escrow until milestones are approved
- Developers receive payment after client approval or automatic release (7 days)
- Platform commission is deducted from each payment
6. User Conduct
You agree not to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Submit false or misleading information
- Harass, abuse, or harm other users
- Circumvent the platform to avoid fees
- Use the service for any illegal purpose
7. Intellectual Property
Upon full payment and milestone approval, all intellectual property rights in the completed work transfer to the client, unless otherwise agreed in writing between the client and developer.
8. Disputes
If a dispute arises between a client and developer, we encourage direct communication to resolve the issue. BuildHelp may, at its discretion, mediate disputes but is not obligated to do so. Our decision in any mediation is final.
9. Limitation of Liability
28 Corp. and BuildHelp are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability is limited to the amount of fees you have paid to us in the past 12 months.
10. Disclaimer of Warranties
BuildHelp is provided "as is" without warranties of any kind. We do not guarantee the quality of work performed by developers or the accuracy of information provided by users.
11. Termination
We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our sole discretion. Upon termination, your right to use the service ceases immediately.
12. Changes to Terms
We may modify these Terms of Service at any time. We will notify you of significant changes by posting a notice on our website. Your continued use of the service after changes constitutes acceptance of the new terms.
13. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction in which 28 Corp. is registered, without regard to conflict of law principles.
